Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Yurii Mokryi (sole proprietorship, Poland) governing your access to and use of DigiPulse (digipulse.cloud). Please read them carefully before using the service.
DigiPulse is intended for users who are at least 16 years of age. By registering, you confirm you meet this requirement.
Acceptance of Terms
By creating an account or using DigiPulse, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the service.
Description of Service
DigiPulse is a website and infrastructure monitoring service that checks the availability, response time, SSL/domain status, and related metrics of URLs you configure, and delivers alerts via Telegram and email. The service is provided on a best-effort basis; we do not guarantee uninterrupted or error-free operation.
Acceptable Use
You agree to:
Use the service only for lawful purposes and in compliance with these Terms.
Monitor only websites, APIs, or endpoints that you own or have explicit written permission to monitor.
Not probe, scan, or test the vulnerability of our systems, or circumvent any security or authentication measures.
Not use the service in a way that generates excessive or unreasonable load on third-party servers beyond normal monitoring intervals.
Not reverse-engineer, decompile, or create derivative works based on the DigiPulse platform or its source code.
Provide accurate and complete information when registering and keep your account details up to date.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@digipulse.cloud if you suspect any unauthorised access. We reserve the right to disable or delete accounts that violate these Terms.
Subscription and Payment
DigiPulse offers a free tier and paid plans as described on digipulse.cloud. Paid subscriptions are billed in advance on a monthly or annual cycle. Prices are displayed exclusive of VAT where applicable. You may cancel your subscription at any time; access continues until the end of the current paid period. We do not issue refunds for unused partial billing periods, except where required by applicable law. If you are a consumer in the EU, you retain the statutory right of withdrawal (14 days) for digital services not yet activated, as required by Directive 2011/83/EU.
Intellectual Property
The DigiPulse platform — including its design, source code, algorithms, and content — is owned by or licensed to Yurii Mokryi and protected by applicable intellectual property law. You retain full ownership of all data you provide (URLs, monitoring configurations, account information). By using the service, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the service. We may use aggregated, anonymised usage statistics — never your personal data or monitored URLs — to improve and develop DigiPulse.
Termination
You may close your account at any time through your account settings or by contacting us at support@digipulse.cloud.
We may suspend or terminate your account immediately and without notice if you materially breach these Terms. For any other termination, we will provide at least 30 days' prior written notice by email. Upon termination, your monitoring data and configurations will be permanently deleted within 30 days.
Limitation of Liability
To the fullest extent permitted by applicable law: (a) DigiPulse is provided "as is" and "as available" without warranties of any kind, express or implied; (b) we are not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, data, or business opportunities — arising from your use of or inability to use the service; (c) our total aggregate liability for any claim arising under or related to these Terms shall not exceed the greater of the total fees you paid to us in the 12 months preceding the claim, or €100. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including internet or infrastructure outages, DDoS attacks, power failures, natural disasters, pandemics, or failures of third-party service providers.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with Polish law (excluding conflict-of-law rules). Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Poland. If you are a consumer resident in an EU member state, you also have the right to bring proceedings before the courts of your country of residence and to use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
Changes to Terms
We may update these Terms at any time. For material changes, we will notify you by email at least 30 days before they take effect. If you do not wish to accept the revised Terms, you may close your account before the effective date at no charge. For minor changes (corrections or clarifications that do not affect your rights), we will update the date on this page without separate notice. Your continued use of the service after the effective date of any changes constitutes acceptance of the revised Terms.
General Provisions
Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect. Assignment: we may assign our rights and obligations under these Terms to a successor in connection with a merger, acquisition, or sale of assets, with 30 days' prior notice to you. You may not assign your account or rights without our prior written consent. Language: these Terms are available in English, Polish, and Ukrainian. In the event of any inconsistency between language versions, the English version shall prevail. These Terms constitute the entire agreement between you and DigiPulse regarding the subject matter herein and supersede all prior discussions or agreements.
